Q A on residence permit (UT) in Sweden for Philippine partners.
1. How can I get a residence permit (UT) in Sweden?
According to Swedish law a foreigner can get a residence permit in Sweden based on a relationship with a person who is living in Sweden. However she/he must apply for residence permit at the Swedish embassy in the country where she/he is living. Children less than 18 years can also apply for residence permit if their care holder is living or intend to live in Sweden
2. What are the differences between a residence permit (UT) and a Schengen visa?
A residence permit allows a person to live and work in Sweden. A Schengen visa allows a person to visit Sweden and other parts of Europe during a period of up to three months. If you want to visit relatives in Sweden during a longer time it is also possible to apply for a residence permit for a visit. More information of how to apply for a visa to visit relatives and friends can be found on the following links:
3. .Do you have to be married to get a residence permit in Sweden based on a relationship?
The answer is No. If you are married your application for residence permit will normally be treated faster by the Migration Board since you are entitled a residence permit. If you apply to live as a couple in Sweden without being married you can have a residence permit and it is your obligation to proof that you are a couple. You will in any case be called to an interview and your partner will will have to proof your relationship by e.g. showing pictures of you from different times and situations.
4. What is easiest? Is it to be married or not before applying for residence permit in Sweden?
If you are in a hurry to get a residence permit in Sweden, both the Philippine and the Swedish bureaucracy will delay your application for residence permit after the marriage. If you are going to get married in the Philippines you must wait a long time (if you don’t have the “right contacts) to get all the necessary papers before you can make the application. If you plan to get married in Sweden you must first apply for a Schengen-visa to visit Sweden, get all the necessary papers from NSO (National Statistics Office) with stamps from DFA (Department of Foreign Affairs) before leaving the Philippines. After the marriage in Sweden you must return to the Philippines to apply for residence permit at the Swedish Consulate in Manila.
6. Can I get a residence permit (UT) in Sweden if my partner is not a Swedish citizen?
If your partner is an EU/EES citizen (but not Swedish) who is settled down in Sweden, you will find the immigration process much easier (especially if you avoid the Philippine bureaucracy). If your partner is not from a EU/EES country (e.g. from the Philippines) who has a permanent residence permit (PUT) in Sweden, the same rules will apply as being a partner to a Swedish citizen.
